1) Acceptance of Terms
By accessing or using Evaari’s mobile apps, websites, and related services (“Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2) Description of the Services
Evaari offers daily self-reflection, gamified progress (including an “infinite karma” style score and avatar evolution), affirmations, and AI-assisted feedback. Outputs are generated using artificial intelligence and may be imperfect.
Well-being Disclaimer: Evaari is for wellness and self-reflection only. We do not provide medical, psychological, or professional advice. In a crisis, contact emergency services (U.S.: 911 or 988).
3) Eligibility
You must be at least 13 years old to use the Services. If you are 13–17, a parent/guardian must review these Terms and supervise your use. Do not upload voices/images of minors without verifiable parental consent.
4) Accounts & Security
Provide accurate information, keep credentials confidential, and promptly notify us of unauthorized use. You are responsible for activity under your account.
5) Subscriptions, Pricing & Payments
Auto-renewing subscriptions via Apple App Store/Google Play:
• Weekly Plan: US$3.99/week
• Annual Plan: US$49.99/year (best value)
Billing & renewal: Subscriptions renew automatically until cancelled. Manage or cancel in your App Store/Google Play settings at least 24 hours before the end of the current period to avoid renewal. Deleting the app does not cancel a subscription.
Trials & promos: If a trial/promo is offered, you may be charged at the end of the trial unless you cancel at least 24 hours before it ends.
Price changes & taxes: Prices may change prospectively; taxes and currency conversions may apply per the Store.
Refunds: Purchases are final except where required by law. Refund requests for App Store/Google Play purchases must be submitted through the respective store. We may, at our discretion, issue courtesy credits.
Adapty & receipts: We use Adapty to validate receipts, manage paywalls, and analyze subscription events (trials, renewals, refunds, cancellations).
6) User Content & Licenses
Your content: You retain ownership of text, audio, images, and other materials you submit (“User Content”). You grant Evaari a worldwide, non-exclusive, royalty-free, sublicensable license to host, process, transmit, adapt, display, and back up User Content solely to provide, secure, and improve the Services (including safety/abuse detection, troubleshooting, and legal compliance).
Generated content (AI outputs): Subject to these Terms and any third-party restrictions, we grant you a personal, non-exclusive license to use AI outputs for lawful purposes. We make no warranty that outputs are accurate or non-infringing; you are responsible for how you use them.
Feedback: If you provide feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
7) Acceptable Use
You agree not to: violate laws; engage in harassment, hate, or exploitation; upload others’ personal data/media without permission; attempt to reverse engineer or interfere with the Service; use automated scripts/bots without our consent; circumvent rate limits; misrepresent outputs as professional advice.
8) Third-Party Services & Flow-Down Terms
Some features rely on third parties including OpenAI (GPT API), Firebase (hosting/notifications), Adapty (subscriptions/paywalls), analytics providers, and the App Stores. Your use must comply with their terms and policies. Features may change or be discontinued if a provider changes their service.
9) Intellectual Property; DMCA (U.S.)
We respect IP rights. If you believe content violates your copyright, email a DMCA notice to [email protected] (subject “DMCA Notice”) including: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material; (d) contact information; (e) a statement of good-faith belief; and (f) a statement under penalty of perjury of accuracy and authority. Counter-notices may be submitted under 17 U.S.C. §512.
10) Disclaimers
THE SERVICES AND ALL CONTENT/OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY). WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVAARI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations; your rights may vary.
12) Indemnification
You will defend, indemnify, and hold harmless Evaari and its affiliates from any claims arising out of your User Content, your use of the Services, or your violation of these Terms or applicable law.
13) Dispute Resolution; Arbitration; Class-Action Waiver (U.S. & Canada)
Informal resolution first: Email [email protected] and allow 30 days to resolve informally.
Binding arbitration: Except for small-claims court and injunctive relief, any dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Seat: Delaware; hearings may be remote. The arbitrator may award individual relief only.
Class/representative actions: You and Evaari waive the right to a jury trial and to participate in class or representative actions; claims must be brought individually.
Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with “Arbitration Opt Out,” your full name, and the email tied to your account.
14) Governing Law
These Terms are governed by the laws of the State of Delaware, USA (without regard to conflict-of-laws rules), subject to any mandatory consumer protection laws of your jurisdiction.
15) Export & Sanctions
You must comply with applicable export control and sanctions laws. You may not use the Services if you are located in an embargoed country or on a restricted list.
16) App Store Terms (Apple/Google)
If downloaded via Apple: Apple is not responsible for maintenance/support; in case of non-conformity (to the extent not disclaimed), you may request a refund from Apple; Apple and its subsidiaries are third-party beneficiaries of these Terms. You must also comply with Apple’s and Google’s terms and policies.
17) Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or law. Upon termination, your license ends and you must cease use. Sections that should survive (e.g., 6, 9–15, 17) will survive.
18) Changes to the Services or Terms
We may modify or discontinue features at any time. We may update these Terms; material changes will be notified in-app and/or by email. Continued use after the effective date constitutes acceptance.
19) Miscellaneous
Severability; no waiver; assignment (you may not assign without our consent; we may assign); force majeure; entire agreement; headings for convenience only; consent to electronic communications.
